This is the typical morality Hindus suffer from like Arjuna suffered during Kurukshetra and Lord Krishna had to remind him of his duty to do it.
When you destroy or kill, leave none behind. Leaving people untouched is applicable when the opponent is following Dharm Yuddha.
Dharma rules don't apply to people who break it often and want it applied when they are losing, Lord Krishna has already spelled out the Dharma for Kali Yuga, "Do as your opponent does, but more efficiently and better than him"

Congress is already a rejected party, they got 78 MLA's and BJP got 104 MLA's please tell me who was rejected ? They were rejected in 20 states of India,

This is not about morality, I don't know why you can't see bigger picture most of time and get carried away with tiny victories of short term which proves costly in long term.

If BJP forms govt without numbers BJP losses votes at all India level, if congress forms govt after being rejected they lose votes in Karnataka during general election and next Karnataka election which you can call anytime of your choosing. There is no downside for bjp for not forming govt but if they do it will become harder to differentiate them from congress.

Bjp doesn’t have majority. Congress +jds has. Why would anyone invite anyone else? It’s like asking upa to form government for 15 days when nda has majority.

Governor's discretion, he called the Single Largest Party, now they have 15 days to engineer enough defections. Either they manage it and win the floor test, or the JDS-Congress forms a short lived Government that ultimately collapses under internal and BJP pressures.

That's right Governors don't have much powers but this is rarest of rare power of Governor and President that they can exercise their discretion on who to invite to form govt and it cannot be challenged or questioned by anyone, neither by SC nor by Parliament.

Media, public, SC can say whatever they want but nothing can be done, whomever Governor invite is completely his decision. It can be amended via constitutional amendment and neither NDA nor UPA amended it so it's foolish to cry now. Governor is not at fault political parties are.

This whole concept of post pole alliance is flawed and breed corruption and must be banned. Instead of money you give them office and license to corruption for forming government. A better system will be when nobody get majority 50% seats selected by lottery goes for snap pole. This is enough to drive anyone to majority and won't affect anyone specifically and less financially costly. If public still don't give majority 1 year of President rule is long enough time for public to decide whom to vote.

Neither the ppl of Karnataka learn nor its leaders. The more things change the more it's the same. Have been watching this BS unfolding in Karnataka since 25 years now .

In the Supreme Court's case, I think they do not have the powers to restrain a Governor's decision making, but I do believe they have the power to review a Governor's decisions and undo them if they find them to be wrong. Nonetheless, the Governor enjoys a lot of influence/power in this type of situation.

Bingo. I saw a lot of people crying about horse trading, but is buying MLA's any less moral than Congress buying an entire party by bribing the party leader with the CM's post? Especially when that party fought the entire damn election on a viciously anti-Congress plank?
 
I heard in te morning from one of the panelists that as per supreme court ruling, the anti-defection law applies only to those MLAs/MPs who have taken oath in the house and it will not apply in this case as the new house has yet to be convened and MLAs yet to take oath.

SC can't do anything at all. It's not lot of power, it's absolute power. His discretion can't be challenged or questioned, period. It's beyond SC, Governor don't have any other power but this few, very few and here he is absolute authority and it's good thing in a way. Sone wild card makes things interesting, otherwise when everything goes by rule it's boring.

No sir, this argument was made today in SC and SC rejected it very harshly. What will be the use of anti defection if this is not covered?

I've been hearing that too, but I'm not completely sure if all the judges on the SC bench agree.

Karma comes to haunt Congress in Karnataka after 22 years:

The year was 1996 & the Gujarat state BJP govt had just fallen thanks to Congress' Governor Krishnapal Singh. Vaghela along with his deputy Dilip Parikh (MLA from my maternal grandmother's birthplace, Dhandhuka) were the masterminds who had open support of Congress to split the BJP & bring the state BJP govt down. They along with Congress resorted to violence inside the state assembly where a no-confidence motion was to be voted & which in all probability was certain to be defeated. Speaker suspended entire opposition for a day. Motion was tabled & govt proved its numbers.

But here comes the twist:
Congress Governor declares based on the pandemonium by Congress + Vaghela faction that the law & order machinery had collapsed in the entire state & that there was a constitutional crisis. After having surpassed his constitutional reach & jumping into the executive's functioning, he sent a report to the central govt. Within 15 minutes of the file reaching the then PM's table, state govt of Gujarat was dismissed & President's rule imposed. This immediately after having proved majority on the floor of the house. Vaghela later became CM for just a year & was succeeded by Parikh who remained CM for 2.5 months. Congress pulled out support from both.

Fresh elections were held. Vaghela's strength reduced from 47 to 4, Congress was kicked out & Keshubhai was voted back as CM.

How is this story relevant after 22 years in Karnataka? Because those quoting verses of morality, constitutional ethics & conventions were perpetrators of murdering democracy & numerous elected govts. right from Nehru.

The Gujarat state BJP chief in 1996 was Vajubhai Vala who today is the Governor of Karnataka.

And the PM who imposed President rule was none other than HD Deve Gowda.

Cong-JDS today want Vajubhai to be merciful reminding him of his duty.

But then there's Karma- Catches all, spares none.

any time. A person fights on a party's 'ticket'. This means he is formally fighting as a representative of the party. He is not independent. He fights on the party's 'symbol', organization and money. As long as that is the case he has to follow the whip. If he is no longer willing to, then he resigns from his MLA position. He can re-cpntest and win as an independent. If that happens he no longer has to follow a whip.

This whole episode is PATHETIC. Proven majority should be asked to form government when there is no doubt. BJP does not have majority and that is just the fact. Alliances can be formed before or after elections as per law. Wth all documentation and MLAs paraded Bharatiya Garbagae Party has once again created a controversy that should not have existed.
