The Constitution leaves it to the Governor's discretion. Koshiyari played it smart. He lobbed the grenade into the court of the EC. It's upto the EC to take a call. Of course if the nomination to the LC or the election doesn't happen, it's not the end of the world for UT, it merely embarrasses him & creates additional complications. For one his allies would insist that they wouldn't work under anyone except UT, should UT taking a page out of Jaylalitha's or Nitish Kumar's book & opt for a proxy from the SS. Alternatively , They'd demand the seat for themselves & set up UT for heavy bargaining in order to accommodate him. All said & done UT will find his opportunism to be more costly than he bargained for while in office too, while governance in Maharashtra goes for a toss.
