Can you please tell me what is correct regarding anti-defection law? You need 66% to be identified as a separate group and avoid disqualification but when does this law come into force? before oath taking or after that?
Once you win election it comes into force, no wait for oath otherwise every rich person will arrange for as many mla as needed for majority as they didn't take oath.

You fight on election either on party symbol or as independent, once EC notified you win an election you are under purview of anti defection law. Oath taking is for taking part in house proceedings, you can take part into house proceedings without oath too but then you are fined and limited.

I went thru the act. the power to disqualify is with Speaker and for that a person has to be a member of the house first. This seems to be a grey area which is not very well defined.

The state of Karnataka awoke to the winds of change on Tuesday, after electoral trends suggest BJP’s emergence as the largest party. As per latest Election Commission data, the BJP has won 91 seats and is leading on 13.

In light of the BJP possibly falling short of the majority mark, the JD(S) can emerge as a kingmaker, possibly at the determent of the BJP, with reports claiming a tie-up between the Congress and Deve Gowda’s party.

However, reports have now emerged that Lingayat MLAs of the Congress are revolting against the party and BJP is in talks with 15 rival MLAs.

Before things looked like going down to the wire, an Indian Express journalist named Naweed Iqbal today suffered a meltdown over BJP’s strong performance in the state, and as a result, grumbled on Twitter:

As seen above, the journalist possibly irked by the Karnataka electoral trends decided to describe India as a “giant cow-belt”. The cow belt is technically considered a combination of northern states like Uttar Pradesh, Bihar, Madhya Pradesh and Haryana, but is often used by so-called liberals, as a snide at religious Hindus who hold the animal in reverence.

Such a manner of professing one’s disgruntlement caught the sight of Twitter users who as a result reacted:

It though remains to be seen whether the journalist revises her perception of the nation if the Congress and JD(S) combine indeed manage to form the government, at the cost of the BJP.
 
Plus bjp with yeddy, reddy and sriramulu...they can pretend to be unified but in reality they will once again start bickering and pushing the government into chaos. The only thing they’re ever unified on is looting and corruption. In that they operate completely smoothly.

In Karnataka, all three parties have potential splinter groups, and all three parties suck.
 
If 15 MLAs abstain from voting or are disqualified, the half way mark will drop to 104 seats and BJP with 104 will be able to prove its majority.

No sir, office of speaker don't dissolve with assembly, previous speaker can decide the fate of defecting mla
 
Won't matter. 10-15 Congress MP's are said to be interested in jumping ship, the Governor is an old associate of Modi from Gujarat BJP, and BJP can always either seek JDS support or split the party itself. Sarkar toh BJP hi banayegi.

As far as i am concerned it is a done and dusted case, you wont see Amitshah sitting quietly after dragging BJP till 105 and give up short of finish line.

Only way i see bjp can form govt is after jds support from outside or otherwise cuz Deve goda will have change of heart as he was not able to keep his party intact forget being CM. Some hardball will make it happen.

So it looks like JDS will not only be a king-maker, but will also be the king. I suppose horse-trading will begin now.

But BJP doing so well riding on the coattails of Modi in a non-BJP state is a pretty big achievement.
The real star is Yogi Adityanath, he toured 33 constituencies and BJP won all 33 seats, now BJP people are lamenting, that he should have toured Bengaluru too, it would have energized Bengalureans to go out and vote more.
While Sree Ramulu is another young star in BJP Karnataka, the sway he has over vast swathes of Dalits,Tribals is too huge.He is another powerful leader being groomed by BJP to be its face in Karnataka in future.

Yes. BJP can ask Cong and JDS MLAs to shift alliances. For example, a small time MLA with no real future can be promised a cabinet seat if he moves to the BJP. Many will be happy with under the table exchange of money and favours as well.

There will be many Cong and JDS MLAs who won't be happy with an alliance. So they can also make the switch out of spite.

Until the govt is fully set up, the election continues.
If i was small time Independent MLA or Congress,JDS MLA, i would ask for a plum post and a bonus of 50 crores, which is more than enough to make up for the switchover.
All BJP needs to do is spend 500 crores and get 50 crore each per MLA and get 10 MLA's in return.
Nobody wanted to swim in a sinking ship, when the Party head Rahul is in Cocaine induced world, his ailing Mom had to come to his rescue, what do you think, the MLA's would feel in such scenario, that RAGA would be PM even though he cant take of elections or responsibility of a single state.
JDS is done, it will be poached by BJP and whatever is left after that it will be absorbed slowly into BJP or it will disintegrate.
