They aren't. However, litigating them through WTO channels would take years, resulting in a pyrrhic victory at best.

The WTO has simply become irrelevant. Globalization is over, trade is getting fractured across separate blocks once again. The double-whammy of Covid and Putinism has seen to that. The question is whether the USA and the EU will be in the same block, or whether there will be a fracture across the Atlantic. The IRA is a first crack; if the EU has balls enough to retaliate it will be a second crack.
 
There is already serious argument brewing in EU over subsidies. Much touted open market policies of west is coming to an inglorious end, they are just doing what developing countries do protect their industries.

You're making it sound that this has only just started. EV drivers have been avoiding road tax as well as congestion charges in London for ages. This is just more of the same. It's about the planet and votes more than competition, although it does affect the latter. No reason the EU shouldn't do something similar.

Protectionism in the US began under Trump, due to China's actions in terms of market access.

But yeah, the global trade order is set to change.
