They're both acts of war/aggression but the scale of the aggression is the determining factor as regards the response. If Pakistan or China were to launch an all out invasion against India as per Russia vs Ukraine, nobody would expect India to hold back. If however, some silly bearded *censored* in Kashmir shoots an India soldier, the scale of the response has to be proportionate and it has to be determined that they were acting in line with Pak orders.

Kashmir was originally independent at the point of independence from the British Empire. Before that India simply wasn't in the same state it is today and existed in various different shapes throughout the ages.
