If I'm not mistaken, SC status is restricted to practitioners of the Dharmic communities & not extended to similar groups in the Christian & Muslim faith which is why there have been persistent demands particularly among the Dalit Christians to make them beneficiaries of affirmative action programs of the government under this act.

As far as ST's go , practically most of the NE and also some tribes in Jharkhand & CHG can claim benefits under the SC / ST act inspite of being of the Christian faith. This is guaranteed by the Constitution which doesn't view these tribes through the lens of religion and has accorded them special status irrespective of the religion they follow.
 
Now coming to OBC, well if you get the full form your doubt will be clear, it stands for Other Backward "Class", not caste, those M&C community which has some history lets say 400-500 years and historically they were treated as backward within M&C and the current economical status of this community within M&C community is kept backward by upper M&C class, then are eligible for quota as OBC. Hence Muslims & Christians get quota as OBC not SC & ST.

so how do you justify Muslims getting reservation in Hyderabad when the Nizams were the ones ruling Hyderabad (what was the name of the last Hindu Kingdom in the region?).
 
wait for 7th Dec, things are changing very rapidly in Rajasthan after what Congress did in telangana.

I doubt that does have any major impact in Rajasthan. Things have been changing here much before that. Ticket distribution and internal politics of Congress is the biggest problem for them. Just like MP in Rajasthan also many people want CM post. Fight is bigger coz winning chances were bigger too in Rajasthan then MP. Sachin Pilot, Ashok Gehlot and CP Joshi everyone was pushing for his candidates. When list was declared, within 30 mins my uncle send a message on our WhatsApp family group "Kon kiska admi hai". A lot of vote cuts are there for this reason. On other hand for BJP mota bhai manage to settle things b/w RSS and Vasundhra. Vasundhra also lowered her tone as she understood if she lost Rajasthan her political carrier is Over.

Also BJP planned it vary carefully with EC. This si the reason election in CG, MP and Raj. are finishing one by one. By 20th nov CG was finished. SO BJP could concentrate on MP and RAJ. Now only Rajasthan remains to fight. It will be photo finish in Rajasthan, but my money is on BJP.

I am justifying anything here, my answer to your question is, it has nothing to do with religion, it is about class. Remember majority muslims in Telangana are converted one not the foreigners from Turkey, Iran or Pashtuns, hence even when muslims ruled this place the economic status of these community was never uplifted because they were considered as 2nd rated by the foreigner muslims in the region.

To understand it even deeply, Kshatriyas in Gujarat/Rajasthan state get reservation benefits as OBC, even when they used to rule this place during medieval times, e.g. Parmars, Solankis & Chavdas. Why do they get reservation, even after holding the 2nd prestigious varna status ? Because as a community they are economically weak. Now if we go nit-picking then we'll get much better idea about how exactly they are "economically weak", but thats completely different issue.

According to Supreme Court, any person belonging to SC/ST community inherits the benefits of reservation even if he/she converts. The community just needs to prove that they are historically oppressed or deprived of several benefits. Yes, Dharmic social structure is always there while considering the quota, otherwise even the anglo-Indians will start claiming quota benefits.

The separation of powers between the legislature, executive and the judiciary form one of the basic tenets of the Constitution. The basic structure of the Constitution also envisages the supremacy of the Constitution, the republican and democratic form of government, the federal character of distribution of powers, secularism, separation of powers between the legislature, the executive and the judiciary and the independence of the judiciary. Addressing the Supreme Court Bar Association’s function on Constitution Day, Chief Justice of India Ranjan Gogoi stated that the cardinal constitutional value is quite simple and it is to ensure being fair towards others, then all problems will be resolved.

Through the decades, challenges pertaining to safeguarding the basic structure of the Constitution came up through different cases before the apex court. For instance, it has been a focal point of constructive debate that the crux of the famous Keshavananda Bharti case is that the Constitution has a basic structure and that basic structure is unalterable.

Supreme Court judge, Justice SA Bobde also spoke on the occasion of Constitution Day. “Each judge of the High Court and Supreme Court, the entire Cabinet and the President of India take an oath to uphold the Constitution. The so-called tensions between the three wings of the government has been considered to be very healthy and vital for for a democracy. Lord Woolf stated that this tension is ‘no more than that created by the unseen chains which hold the three spheres of government in position. If one chain slackens, the other needs to take the strain.”

A more elaborate interpretation was elucidated by Mr. Fali.S.Nariman at a separate event. “It is easier to draft a Constitution than to work it. We will never be able to piece together a Constitution in the present day even if we try, apart from the number of people who have different opinions today. In Constitution making, there are invisible forces that can never be and the spirit of tolerance, which is at a very very low ebb today. From decade to decade, regional parties have strengthened their roots, become far more vocal and dominant in Indian politics. We had our difficulties. Language, for instance. We almost broke up. India would never have been India if you read our history but for the language resolution that got passed by one vote, not because people wanted English and it was to keep the North and the South together and that is why it may continue to make One Nation. So, now Hindi and English are accepted as national languages.”

“One of the great things that have happened particularly after the 1980s, which I believe to be a creative judiciary, as enlarged the concept of right to life in Art 21 of the Constitution …it refers to your right to live. You can’t take it away. Not only the right to live, but there is also the right to a healthy life, the right not to be polluted. I always thought this was an overburden which was unnecessary but Prof Baxi rightly pointed out that we have a fundamental rights chapter in which Article 21 is there and we have a state policy chapter that was a closed book in a court of law. So what did courts the do? They expanded Article 21, therefore, the right to issue writs, orders were paramount and which I call as the searchlight provisions of the Constitution, Article 32 and Article 226 and Art 136,” the eminent jurist said.

So, are courts crossing the line when it comes to interpreting constitutional law? A valid question.

Mr. Fali S. Nariman further explained, ”See what the Ramayana really said. Sita asks Rama to fetch a deer. Rama goes in search of one, asking his brother to stand in guard. The golden magical deer is in fact the demon who distracts and cries out in Rama’s voice which distresses Sita. What does Lakshman do? He draws a perimeter line and says you must not cross this. Sita, out of compassion for a visiting guest who is Ravana in disguise, crosses the line and gives him food. Following this, Sita is abducted. Great constitutionalists apply this metaphor to courts. They say that you are forbidden by Art 37 of the Constitution to enforce by this order the large number of directive principles of state policy.”

“For the constitutionalists, the principles of state policy which cannot be enforced in courts of law is the lakshman rekha. However, since 1986, the Supreme Court, for the first time, changed this. Judges have, since then, crossed the lakshman rekha in matters relating to Part 4 simply because the state has failed to implement the directive principles of state policy. In so doing, the Judges sitting in Supreme Court have converted the primary human needs into human rights, making them enforceable. This is a great innovation that courts have done. As the Ramayana itself depicts, the Lakshman Rekha can be crossed only when necessary but when it is done, it is always and only for a good cause. That is the answer for those who say that the Lakshman Rekha cannot be crossed,” he added.

Speaking on the occasion of Constitution Day, Union Law Minister Ravi Shankar Prasad stated, “The Constitution is not only a document of empowerment but also a charter of inclusion of equity.Some people have observed that the Constituent Assembly was the paradise for lawyers. I strongly differ, there were eminent lawyers but they had suffered in jail, fought lathis and organised people of India behind Gandhiji.”

Supreme Court judges, Justices Madan Lokur, Kurian Joseph and Indu Malhotra were present at the Constitution Day function organised by the SCBA. Attorney General KK Venugopal briefly addressed the gathering, followed by SCBA President Vikas Singh.

My predictions for the results of five state elections is 4-1 for BJP and we might see 5-0 with outside support of BJP in Telangana. MNF will form govt in Mizoram with BJP support. I say CG- 45-52, MP-130-140, RJ-105-110 for BJP.
Nearly every exit has got it wrong once again. They have not factored in the RSS and the BJP voter in their calculations. In all states where they are predicting loss for BJP, they have forgotten that BJP voter is a committed voter who does not change loyalties. AND when we have large number of voting for others, BJP emerges a clear winner. In RJ everyone is predicting a large vote share for others which means a sweep for BJP same is the case for CG and MP. I am not at all in agreement with Telangana results as my information tells me that BJP will hit double digits. KCR will have to choose between Owaisi and BJP to form the Govt. Let us wait for 11th evening.
RJ has probably voted about 77-78% today thanks to RSS and mobilisation of their cadre.
 
Raman Singh & Mama Ji gonna win but Rajasthan (n)
Most polls like India Today / Aaj Tak, Times Now, etc are already predicting a 3-0 win for Cong (I). I think MP & CG is too close to call, going by the very slim difference in seats gained by either parties, in practically all the polls surveys.Rajasthan, of course, is a goner for BJP.

A very large number of seats in RJ will have very very thin margins. So it is very difficult to call. But I am very confident of BJP win. Lot of pollsters have got it wrong about Mewar/Marwar and Jaipur Region which have voted one sided for BJP.

Don't write BJP off completely yet even in RJ. Congress bungled things big time, and I believe the possibility of a fluid/tight situation with a hung assembly or INC on a dangerously wafer thin majority (prone to poaching and upheaval) are still there.

It's not me nor the various poll analysis, which I've learned to take with a pinch of salt. It's just Rajasthan's electoral results in the past 2 decades which makes such a result predictable. Frankly, between Gehlaut &" 8PM no CM," the former enjoys a far better reputation as an able administrator. Even his worst critics seem to think so. Yet, every 5 years, in spite of his reputation, he's out. What makes you guys so optimistic, Raje would survive?

Yet, every 5 years, in spite of his reputation, he's out. What makes you guys so optimistic, Raje would survive?

It's certainly possible she gets booted out, I'm not denying that. But with the massive RSS mobilization & high turnout, Modi & Yogi rallies which had huge responses (both are immensely popular in the state), Kirorilal Meena's return to BJP (he has a strong command over the Meena votebank, who otherwise prefer INC), Jat leader Hanuman Beniwal strongly cutting anti-incumbency votes & Jat votes which would have otherwise gone to Congress - and also likely being open to work with BJP again post polls, the Rajput anger at BJP likely being overhyped in media, an incredibly large amount of Rajasthanis benefitting from Modi's welfare schemes (gas, toilets, electricity, homes, medicare etc), Congress's infighting and massive screw up during ticket distribution and a few other reasons that escape me right now - I dare to say that things could end up tight and the situation could be fluid, with "Others" playing a crucial role in Govt formation, which is where I think BJP has an upper hand due to Amit Shah, Money power, Central Agencies, and friendly "Others" like Beniwal.
